Samsung Electronics has failed to persuade a California judge to order a retrial after losing its US$1 billion
patent fight with Apple Inc.
As reports from SiliconValley.com and ComputerWorld U.S. detail, Justice Lucy Koh released a decision Monday that dismissed Samsung’s allegation that jury foreman was biased because he was involved in litigation with hard drive maker Seagate that could have affected his vote.
But the judge said Samsung should have pursued the matter during the trial.

At the same time, the judge also refused Apple’s motion for a U.S. permanent injunction on some Samsung products that infringed Apple patents. That apparently led Samsung to stop its attempts Tuesday at banning Apple products in Europe, it was reported by Reuters.
This doesn’t end the legal matters, however, because both sides can appeal to higher courts.
